Terms and conditions of use

1. Terms and Conditions (“Terms”)

Terms are entered into by Carbon4Climate “we”, and “you”. Reference to “you” or “your” in these Terms means the entity or individual that has consented to these Terms by any binding method of acceptance of these Terms.  By accessing or using the website (“the site”) you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Carbon4Climate site. 

We reserve the right to make changes to these Terms.  We will inform you of any material changes to these Terms.  By continuing to access or use our site after those revisions become effective, you agree to be bound by the revised Terms.

 2. Annual payment plan

You understand and agree that you have committed to a contract. And you agree to membership fees payable at a rate of $30 per tonne of carbon dioxide removal purchased.  Memberships are automatically renewed. 

 3. Cancellation of Annual Payment Plan

You understand that you are able cancel your membership at any-time.  Former members retain ownership of their previous carbon removal purchases and retain access to the site to manage their carbon credits.

 4. Refunds   

There is no refund from the purchase of an annual membership.

You may ask for a refund of your membership fees during the first 30 days of your subscription.  If your membership fees are refunded, you will be removed from the site and your carbon removal purchase canceled.   You may also have rights granted to you by law which may entitle you to a refund of fees in specific circumstances.  Apart from those things, refunds of membership fees will not be made.

 5. Re-sale of carbon credits

The purchase of each tonne of carbon dioxide removal may result in the generation of a carbon credit, also known as an off-set.  Each project must go through third party off-set verification and comply with all the rules and regulations related to off-sets in the jurisdiction of the project.  

Carbon credits are formalized as each project is implemented.  Once the lifecycle analysis of the carbon reductions is verified by the third party, the carbon-offsets become a type of currency that can be sold or traded on trading platforms or to buyers directly or through the site.  

You understand that your carbon off-set purchase may have no formal monetary value if the project is not accredited for any reason.

 6. Membership

If you are under 18 years, you need your parents’ permission before becoming a member and accessing the site.

You are responsible for every use of the site that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential. You must notify us as soon as you become aware of any unauthorised use of your membership, username or password.

Your membership is transferable. You must contact info@carbon4climate.com to have your user name and password replaced with another user.  

 7. Availability and Use of the Site

The site will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the site or the provision of its services and content, for maintenance, technical or other reasons.

 8. Rights to Content, Intellectual property

Each item of content is copyright of its author. 

All Carbon4Climate and Titan Clean Energy Projects trade marks (whether registered or unregistered) and graphics, logos, designs, page headers and button icons are the intellectual property rights of Carbon4Climate or Titan Clean Energy Projects Corp.  You must not use these without written approval of the owner.

 9. Privacy

We will protect your personal information in accordance with our privacy policy.  This policy is intended to account for the General Data Protection Regulation (“GDPR”) in the EU.  

 10. Refusal, suspension or termination of membership

We may, in our discretion, immediately restrict, suspend or terminate your membership and access to the site if we consider you in breach of these Terms, or any other site rules or applicable laws.

We reserve the right to refuse membership at our discretion.

All provisions of the Terms shall survive any termination of your access rights to the site.  

 11. Liability and disclaimer

Except as provided in an applicable non-excludable Law, we are bound only by the express promises made in these Terms and are not bound by implied terms.

Except as provided in an applicable non-excludable law:

a). We do not promise that the content or your access to the site will be uninterrupted or error-free, that any defects will be corrected, or that the site or content are free of viruses or any other harmful components; and,

b). we make no promises regarding your access to, or the results of your access to, the site or content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

Except as provided in an applicable non-excludable law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss or revenue or loss of profits which result from any use of or access to, or any inability to use or access the site.

 12. Limited Liability

Your sole and exclusive remedy for dissatisfaction with the site is to stop using the site.

 13. Project choice

Members vote for their preferred project.   Should the project that receives the most votes be canceled for any reason, membership fees will be directed toward the next most popular project.  

 14. Applicable Laws

The laws of Canada govern these Terms.
